2. Make a contract with us

2.1 When you place an order with us, you are making an offer to buy goods. We will send you an e-mail to confirm that we have received your order.

2.2 In the unlikely event that the goods are no longer available, or that we have made a pricing mistake, we will advise you of this. You will receive an e-mail with further information and there will be no contract between us.

2.3 Images of products on this website are for illustrative purposes only. Your goods may vary slightly from the image shown on the website and will not include any of the pictured accessories, unless stated in the specification of the goods. 

2.4 We have made every effort to display as accurately as possible the colours of our products that appear on this website. However, we cannot guarantee that your monitor's display of any colour will accurately reflect the colour of the actual goods.

2.5 Whilst we try to be as accurate as possible, all information provided is approximate and is provided in good faith.

2.6 This contract is covered by English law.

2.7 By placing an order with us, you agree to and accept these terms, as well as our privacy policy and the terms of website use.

3. How to place an order

3.1 You can use our website to place an order by selecting the product you wish to buy and adding it to your basket. Items you do not require can be removed from your basket at any time. If you prefer to order by email you can do so by contacting sales@trouvailleglobal.com.

3.2 The buyer assumes responsibility for the goods being suitable for the purpose for which they are being purchased.

3.3 Carriage charges will be shown prior to you placing your order.

3.4 You will be required to pay for the goods in full at the time of ordering.

3.5 We use secure payment facilities for online purchases. You can pay for your order using Paypal, MasterCard, Visa and American Express.

3.6 Promotional prices only apply during the period stated.

3.7 All prices quoted in UK orders include Value Added Tax. Please note this is not the case for orders that are to be shipped outside of the UK, where each country may impose taxes on the product.

3.8 Please be aware that once the following takes place: 1. you have successfully placed an order; 2. we have accepted it; 3. it has been received by our warehouse, we are unable to amend the order or details provided. Please note that this does not affect your right to cancel a contract in accordance with clauses 5.1-5.8.

3.9 Trouvaille Global Ltd may cancel any contract between you and us and not supply Products if it is reasonable to do so and may change or discontinue the availability of Products at any time at its sole discretion. If we cancel your order, any payment made for the Products will be refunded in full.

4. Price, Delivery & Carriage Charges

4.1 Goods available will be dispatched from our warehouse within 3 working days and any estimated dispatch date is an estimate, which can change without notice. Dispatch may be delayed in accordance with point 4.11.

4.2 Estimated delivery times will be outlined during ordering process, according to shipping method selected. Deliveries may be delayed in accordance with point 4.9.

4.3 The price for each Product is shown on the website and includes any relevant sales taxes (such as VAT) at the current rate for the UK. All orders are charged in Pound Sterling (GBP) and any quotes shown on the website in US Dollars and Euros are for orientation only and are approximate value converted from GBP based on current market exchange rates for USD and EUR (subject to quarterly updates). As all orders are charged in GBP, your card provider may charge their own exchange rate where currency rate differs from our approximate values provided on the website. 

4.4 We always try to make sure that the prices on the website are accurate but errors may occur. If we discover an error in pricing of the Products that you order we will notify you as soon as possible using the contact details you supplied to us when placing your order. We will then give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to reach you within 7 days of our notice we will treat the order as cancelled. If you cancel, any payment made for the Products will be refunded in full. If you confirm, you must pay the difference before we despatch the Product.

4.5 You will be notified of the delivery costs automatically before you submit your credit card details, based on the delivery address you specify. 

4.6 GBP as payment currency will be always shown as method of payment on your receipts and other currency values are  Please note that refunds are made in the same currency as the original payment (which is always GBP), and we cannot be held responsible for any loss due to exchange rate fluctuations.

4.7 Trouvaille Global Ltd delivers to destinations inside and outside the UK. Delivery outside the UK may be subject to local import duties, customs duties or taxes which are your responsibility where they apply. Unfortunately we cannot advise you what these charges will be and Trouvaille Global Ltd is not responsible for them. ​If you do not pay these local import/customs duties or taxes then the Product could be returned to Trouvaille Global Ltd or possibly destroyed if too expensive to return. Please note, if this happens, we may not be able to refund your purchase. You must comply with all applicable laws and regulations of the country for which the Products are destined. We will not be liable or responsible if you are in breach of any law in any such country.

4.8 If you change the delivery address once the goods have been dispatched to you, we reserve the right to pass on any extra charges made by our carriers for redirecting your delivery, if the carriers are able to make the change. This will delay your delivery.

4.9 Please check the goods on delivery - any goods found to be missing or damaged should be notified to the delivery driver at the time of delivery or ourselves within five working days of delivery of the items.

4.10 If the goods are lost or damaged please report this to us within five working days from the expected delivery day.

4.11 Sometimes, for reasons beyond our control we may be prevented from delivering your goods as planned. These might include things such as third party supplier services delays, accidents, breakdowns, fire, flood, storm, severe weather, acts of god, war, riot, civil commotion, malicious damage or the default of our suppliers. We are not responsible where this causes a delay or failure in delivering your goods.

4.12 Time is not the essence of the contract unless expressly stated otherwise in writing by a Director of the Company.

4.13 Free, non-tracked delivery option is offered to UK addresses for orders above £25.00. Shipping method used to fulfill free delivery is solely determined by Trouvaille Global Ltd and subject to change at any time. Trouvaille Global Ltd reserves the right to amend or withdraw free shipping offer at any time without prior notice.

5. Cancellation and returns

5.1 This policy does not apply to goods ordered by businesses which are exempt from the Distance Selling Regulations. For Trade and Business customers, please see section 8.

5.2 You can cancel your contract at any time up to 14 days after the day of delivery. To do this, please e-mail or write to us. We are unable to accept cancellations by phone.

5.3 You do not have to give any reason for cancellation. However, a brief explanation will help us to improve the service we offer to customers in the future.

5.4 If you cancel, you must return the goods within 14 days of cancellation, complete with the original packaging to us and/or our supplier (or any other UK address specified by us), at your own expense. You must ensure that the goods are packaged adequately to protect against damage.

5.5 If you fail to return the goods, we will collect them, and we will charge you the direct cost of collection. If you fail to take reasonable care of the goods before they are returned to us, and this results in damage or deterioration, we will charge you for the reduction in value.

5.6 We will refund all monies paid to us by you including any postage / carriage within 30 days, less any costs due under this contract. Please see point 5.1 for exemptions.

5.7 We are not liable for any loss earnings due to late, incorrect or lost deliveries.

5.8 We reserve the right to refuse replacements on any damaged items reported to us outside of five working days. Please refer to points 4.9 and 4.10. 
This cancellation policy does not affect your legal rights - for example, if goods are faulty or misdescribed.

6. Faulty Goods

6.1 If there is a problem with the goods, please notify us by email or in writing providing details of the problem. In addition, you must provide us with a digital photograph of the problem as this saves you having to return the goods for inspection. We will deal with the matter in accordance with your legal rights. Please see points 4.7 and 4.8 for time restrictions.

6.2 If an exchange is necessary, this will be arranged without unreasonable delay and without charge. Replacement goods will not be dispatched until either an indicative digital image is supplied by the customer, or the original goods have been received at our warehouse and checked. 
The cost of returning goods to us is your responsibility, however on inspection we will refund your reasonable postage costs, providing that the goods are found to be faulty. If the goods are not faulty, we will return them to you, however you will be required to cover our reasonable postage costs.

6.3 As a consumer, you have legal rights in relation to Products that are faulty or not as described. Advice about your legal rights is available from your local Citizens’ Advice Bureau or Trading Standards office. Nothing in these Terms will affect these legal rights.

7. Liability

7.1 The products sold on this website have been designed to comply with all relevant UK and EU legislation. 

7.2 Unless specifically agreed between parties, we only supply the Products for domestic and private use. You agree not to use the Product for any commercial, business or re-sale purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity

7.3 We do not in any way exclude or limit our liability for

     1. death or personal injury caused by our negligence

     2. fraud or fraudulent misrepresentation;

     3. any breach of the terms implied by section 12 of the Sale of Goods Act 1979 (title and quiet possession)

     4. any breach of the terms implied by section 13 to 15 of the Sale of Goods Act 1979 (description, satisfactory quality, fitness for purpose and samples); and

     5. defective products under the Consumer Protection Act 1987.

8. Trade or Business Customers

The following conditions apply to orders placed by Trade or Business Customers.

8.1 Orders may not be cancelled except with our mutual agreement and having been confirmed in writing by a Director of our company. We reserve the right to make cancellation and/or re-stocking charges.

8.2 Claims for missing or damaged items must be made in writing within 2 working days of delivery. Goods deemed faulty are to be returned at the cost of the buyer. Upon confirming the fault of the goods, free replacements will be arranged. We do not offer credit notes unless replacements are not available.

8.3 The buyer assumes responsibility for the goods being suitable for the purpose for which they are purchased.
